Limitation of Liability

Hazardous conditions exist at Thunderbird Lake Tahoe and surrounding grounds including but not limited to tunnels, shafts, cliffs, loose masonry, wild animals, extreme heights, uneven walking surfaces, heavy machinery, toxic chemicals, water and electrical hazards, and these and other hazards may cause injury or death. PERSONS ENTERING THE PROPERTY DO SO AT THEIR OWN RISK. Thunderbird Lake Tahoe (TLT) reserves the right to restrict access to or from any area at any time.

You agree to release and hold TLT, its employees, directors, officers, agents, and property managers free and harmless from any and all loss, liability or costs (including reasonable attorneys’ fees) which you may or could sustain, incur or assume as a result of any claims which may be alleged, made, instituted or maintained against TLT arising out of (directly or indirectly) your use (expressed or implied) of the Property or in any manner pertaining to the Event, including without limitation, injury or death to persons or damage to property or business by reason of any cause including claims of copyright or intellectual property infringement.

Prohibited Uses and Activities

Visitors to Thunderbird Lake Tahoe and surrounding property shall not engage in any prohibited use or activity pertaining to the event or property including but not limited to:

1. Smoking anywhere on the Property—including beaches, balconies, forests, restrooms, and roadways — except within the exterior Gazebo building. This smoking policy is mandated by the Fire Inspector and any violation thereof shall result in the immediate eviction of the offending person from the event.
2. Unlicensed use or activities requiring a governmental license, permit, or certification.
3. Parking in other than designated areas.
4. Any activity, use, or access outside of the permitted areas designated by TLT staff.
5. Climbing upon any tree, structure, or apparatus.
6. Consumption of alcohol (except as prescribed in Alcohol and Illegal Drug Use, below).
7. Throwing or sowing rice, birdseed, or flower petals. (Releasing bubbles, doves, and indigenous butterflies are permitted.)
8. Swimming in the Lake, diving from the structures, or water play of any kind.
9. Bringing any pet or animal onto the Property except assistance dogs for the disabled.
10. Damaging or defacing any element of the Property, its furnishings, art, or fixtures.
11. Feeding, calling harming, encroaching upon, or interfering with the movement of any animal or bird; fishing on the Property is not permitted.

Using every legal means available, TLT may immediately evict any person from the Property at any time for any reason whatsoever.

As part of our service, we agree to provide you with information and other services that we may decide to offer, subject to the terms of this agreement. Upon notice published through the service, we may modify this agreement at any time. You agree and continue to agree to use our services in a manner consistent with all applicable laws and regulations and in accordance with the terms and conditions set out in the policies and guidelines outlined below. Please note that you will be referred to as 'customer' in this agreement.

SERVICES ARE PROVIDED 'AS IS,' WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY FOR INFORMATION, SERVICES, UNINTERRUPTED ACCESS, OR PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH THE SERVICE, INCLUDING WITHOUT LIMITATION THE SOFTWARE LICENSED TO THE CUSTOMER AND THE RESULTS OBTAINED THROUGH THE SERVICE. SPECIFICALLY, WE DISCLAIM ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION: 1) ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY OR CONTENT OF INFORMATION, PRODUCTS OR SERVICES; AND 2) ANY WARRANTIES OF TITLE OR WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORD, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION. CUSTOMER SPECIFICALLY ACKNOWLEDGES THE SERVICE IS NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER CUSTOMERS OR THIRD-PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH CUSTOMER.

NEITHER THE SERVICE NOR ANY OF ITS AGENTS, AFFILIATES OR CONTENT PROVIDERS SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF USE OF THE SERVICE OR INABILITY TO GAIN ACCESS TO OR USE THE SERVICE OR OUT OF ANY BREACH OF ANY WARRANTY. CUSTOMER HEREBY ACKNOWLEDGES THAT THE PROVISIONS OF THIS SECTION SHALL APPLY TO ALL CONTENT ON THE SERVICE.
